Filing For Bankruptcy: A Good Last Resort Solution To Becoming Debt Free
There are many different ways of looking at bankruptcy though a common perception is to believe that filing for bankruptcy will help a person take good care of all of their debts and that after filing for bankruptcy life will be nice and rosy for them once more. This can lead to some people making a habit of filing for bankruptcy as often as they like while other people that should consider filing for bankruptcy do not do so on account of fearing about what other people will think about them.
No Assurance
The plain truth is that there is no assurance that after filing for bankruptcy you will be able to become absolutely debt free. There are certain kinds of debts such as child support, alimony payments, student loans as well as fraudulent debts and any major purchase that includes spending over five hundred and fifty dollars to purchase items of luxury that will not be gotten rid of so easily, especially not by simply filing for bankruptcy.
Furthermore, as an individual filing for bankruptcy you need to decide whether to file for Chapter 7 or Chapter 13 bankruptcy with the former being the best option for complete liquidation of debts. However, you can only file for Chapter 7 bankruptcy after the Federal bankruptcy laws, when applied, show that you are eligible to apply for this form of bankruptcy.
You might also consider filing for bankruptcy (Chapter 13) which is different than Chapter 7 bankruptcy in that this form of bankruptcy helps you reorganize your debts rather than completely liquidate the debts. The good part of course is that Chapter 13 bankruptcy helps ensure that you only pay pennies on the dollar and so will be in a better position to repay your debts in order to achieve your financial freedom once more.
Usually, when filing for bankruptcy (Chapter 13) it takes between three and even five years to get rid of all of your debts. Also, you will need to go through quite a few different stages in Chapter 13 bankruptcy before achieving your goal. It is permitted to keep certain assets and these are in fact protected under laws pertaining to Chapter 13 bankruptcy. However, just as is the case with Chapter 7 bankruptcy, there are many qualifications that have to be met before you are allowed to file for Chapter 13 bankruptcy.
Remember however that before filing for bankruptcy to try out all other available means and that bankruptcy should really be your last resort.
